How does overtime work in California?

California is stricter than federal law. Under Labor Code § 510, non-exempt employees earn 1.5× the regular rate for workday hours over 8 up to and including 12, 2× for hours over 12 in a workday, 1.5× for the first 8 hours and 2× beyond for any work on the 7th consecutive day of the workweek, and 1.5× for hours over 40 in the workweek.

What is the 2026 California salary threshold for exempt employees?

In 2026 a salaried exempt (executive, administrative or professional) employee must earn at least twice the state minimum wage for full-time work: $1,352 per week, $5,858.67 per month, or $70,304 per year ($16.90 × 2 × 40 × 52). That is higher than the federal $684/week floor. The salary is only one test — the employee must also primarily perform exempt duties.

Do daily and weekly overtime stack in California?

No hour is ever paid twice — but both rules still run. Hours beyond 8 in a day are daily overtime; separately, the hours past 40 in the week that are not already overtime hours become weekly overtime. Work 10 hours Tuesday to Friday plus 4 hours Saturday (44 hours) and you earn 8 daily-overtime hours plus 4 weekly-overtime hours for Saturday — 12 premium hours. Work five 10-hour days (50 hours) and the final 10 hours of the week sit above the 40-hour line: Friday’s 2 overtime hours stay daily overtime, while Friday’s 8 straight hours become weekly overtime — 18 premium hours.

How is the 7th consecutive day paid in California?

On the 7th consecutive day worked in a workweek, the first 8 hours are paid at 1.5× the regular rate and every hour beyond 8 at 2× — so a full 8-hour shift on day seven is entirely premium pay, even if the week has stayed under 40 hours.

How much is 10 hours a day at $20 per hour in California?

Five 10-hour days at a $20 regular rate: 32 hours at straight time ($640) plus 18 premium hours at 1.5× ($540) — total $1,180 for 50 hours. (The 18 = 10 daily-overtime hours plus 8 of Friday’s straight hours that fall over the weekly 40-hour line.) The same schedule at $25/hour pays $1,475.

No — this calculator covers hours and rates only.
